This course covers sexual harassment, sexual misconduct, and culture challenges in athletics and will also delve deeply into program equity compliance. Attendees will leave with a better understanding of why program inequities exist and how to spot red flags and address them.

Informal Resolutions Foundations for Higher Education

This foundational course aims to familiarize participants with ATIXA’s Informal Resolution Framework and the crucial elements to consider when deciding whether to offer informal resolution in a Title IX grievance process. It covers various topics, including the structural and policy choices that institutions must make and how institutional culture affects them.

Rather than adopting a particular model of alternative dispute resolution (facilitated dialogue, restorative practices mediation, etc.), ATIXA’s experts will survey a variety of options and introduce a unique model that is specifically suited to Title IX complaints by borrowing elements of various models while adding some innovative practices uniquely designed to facilitate durable, fair, and equitable resolution of Title IX complaints.

Investigation Foundations for Higher Education

This course equips individuals with the essential skills to carry out investigations of sex- and gender-based violence, harassment, and discrimination complaints. It also includes a comprehensive examination of the Title IX Formal Grievance Process and the role that the investigation, investigator, and investigation report play in it. Participants can easily customize the concepts and investigation framework to investigations under other civil rights laws, such as Title VI, Title VII, the ADA, and Section 504 of the Rehabilitation Act.

Gender Equity Foundations for Higher Education

This course focuses on sex discrimination compliance responsibilities. It covers the assessment of overall program equity and provides introductions to athletics equity, pregnancy and related conditions requirements, and LGBTQIA+ protections.

ATIXA’s expert faculty members will guide participants through ATIXA’s model formal grievance process from a sex/gender discrimination complaint perspective. Discussions will also cover how institutions can center resolutions that involve disparate treatment and impact, including targeted culture/climate assessments and investigations. Lastly, the course will address what institutions can expect when the U.S. Department of Education’s Office for Civil Rights (OCR) reviews their program equity compliance and how to develop a plan to complete gender equity audits regularly.

Investigating Sex/Gender Discrimination and Disparate Treatment Workshop

As a sex/gender equity law, Title IX prohibits discrimination. This workshop sharpens participants’ skills in investigating discrimination complaints that fall into categories commonly termed disparate treatment (intentional) or disparate impact (unintentional) by the courts. Such complaints often involve investigating the impact of climate/culture, policies, and practices.

Intentional discrimination may include investigations of pay equity issues, favoring or disfavoring by sex, LGBTQIA+ exclusion, facilities disparities (housing, locker rooms, etc.), and program exclusion. These types of investigations require different skills and methodologies from harassment investigations and are predicated on other policies.

ATIXA’s expert faculty members will guide participants through ATIXA’s recommended investigation process for sex/gender discrimination complaints, sharing practical knowledge and tips to prepare participants to investigate complex complaints.

Supportive measures can be crucial for individuals contending with the aftermath of sexual violence or other conduct covered by Title IX. This seminar offers a comprehensive overview of ATIXA’s recommended best practices to support the needs of all parties involved in the Title IX process. This includes adhering to federal requirements under Title IX and the Clery Act/VAWA Section 304.

Title IX work often focuses on response, but effective prevention means fewer incidents. It is essential to understand what prevention entails, how it operates, and how it can be optimized to reduce misconduct. Managing Retaliation Complaints Seminar

January 26, 2024 | 1:30pm-3:30pm EST

Nearly all Title IX practitioners will have to respond to retaliation complaints during their careers. They’re materially different from other Title IX complaints concerning analysis and assessment of intent, and retaliation is generally more complex and challenging to address.

Counter-complaints are increasingly common, posing challenges regarding timing, appropriate charges to file, how many procedures are required, and ensuring counter-claims are not retaliatory. These difficulties are further compounded by the sophisticated multi-step analysis needed to determine whether conduct meets the retaliation standard and the distinct definition of retaliation in Title IX regulations.

This seminar is designed to provide practitioners with a deep dive into core concepts for evaluating the merits of a retaliation allegation, managing retaliation complaints amidst continuing resolution of the underlying complaint, and how to minimize the risk of cat’s paw liability.

Winter Symposium attendees will have the opportunity to contribute to local organizations in Florida that make a difference in people’s lives and focus on the issues of racial justice and LGBTQ+ equality. ATIXA worked closely with SocialOffset to select five vetted charities that work toward our equity goals to help balance the scale. Each cause was determined based on specific criteria, including that it must be local and spend at least 75% of all donations on services offered. ATIXA has chosen the following charities: Equality Floriday Action Inc., Florida Legal Services, Planned Parenthood of Southwest and Central Florida, Second Harvest Food Bank of Central Florida, and Coalition for the Homeless of Central Florida.

ATIXA understands that circumstances change, and issues may arise that prohibit your ability to attend this event after you have registered. Our cancellation and refund policy is outlined below:

  • Registration cancellation more than 6 weeks prior to registration deadline = 50% refund on the full registration price issued via cheque within 30 days of ATIXA receiving notification
  • Registration cancellation less than 6 weeks prior to registration deadline = no refunds on the full registration price
  • If you opt in for credit instead of a refund, you will receive 100% of the purchase price via a credit that can be used toward future ATIXA trainings. All credits will expire by December 31st, 2024. Please refer to ATIXA’s event policies for more information.

Scholarship applications are open until December 1, 2023. All attendees are welcome to apply.

Please note that scholarship awards cover course, workshop, or seminar registration only. Flights, meals, hotel accommodations, and transportation are not included.

Those attending training and certification courses will receive a 2-year certification and renew any current certifications. Those attending workshops and seminars will NOT receive a certification, but will receive digital badges. Workshop attendees receive 4 CCCs with Seminar attendees receiving 2 CCCs.
