Protecting Gender Diversity in Education Workshop

11:00am-3:00pm ET

This workshop offers practical skills for navigating complex and emerging landscapes related to gender identity and expression in educational environments, including complaints of misgendering, mispronouncing, and deadnaming.

ATIXA’s expert faculty members will discuss best practices to comply with relevant federal laws and court decisions, including when state or local laws conflict. There is a lack of consensus among courts when Title IX/Equal Protection rights intersect with First Amendment freedoms, whether inside or outside the classroom. This workshop is designed to assist Title IX administrators in managing these complex matters.

They will present best practices for a school or institution to support gender diversity and offer recommendations to ensure a supportive and inclusive educational community while protecting religious and academic freedom. Click here to learn more.

Navigating Single-Sex Programs & Equitable Access Workshop

11:00am-3:00pm ET

This workshop focuses on single-sex program discrimination issues related to Title IX compliance, which have resulted in more than 300 recent OCR complaints against colleges and universities and tend to receive less attention than sexual harassment and assault.

ATIXA’s experts will lead a discussion on single-sex programs and disparate treatment. Attendees will learn about disparate treatment based on sex and how to distinguish it from disparate impact. Participants will learn which single-sex programs the Title IX regulations permit and how to implement them, how to recast single-sex programs to ensure they don’t violate Title IX, and how the “significant assistance” standard can have Title IX implications related to external single-sex organizations. Lastly, the course material will touch on academic (non-athletic) scholarship equity and any relevant Title IX implications. The workshop will also offer an exploration of affirmative action options and how they may be used to justify single-sex programs.

Writing Outcome Rationales Workshop

Proficiency in writing precise rationales is essential for both investigators and decision-makers during the formal grievance process. Rationales are intricate and require significant analytical and writing abilities to effectively convey the practitioner’s thoughts. This includes analyzing all relevant facts, applying policies, assessing credibility, applying the standard of proof, making a final determination, elaborating on sanctions, and providing reasons for the decision.

Investigating Sex/Gender Discrimination & Disparate Treatment Workshop

As a sex/gender equity law, Title IX prohibits discrimination. This workshop sharpens participants’ skills in investigating discrimination complaints that fall into categories commonly termed disparate treatment (intentional) or disparate impact (unintentional) by the courts. Such complaints often involve investigating the impact of climate/culture, policies, and practices.

Intentional discrimination may include investigations of pay equity issues, favoring or disfavoring by sex, LGBTQIA+ exclusion, facilities disparities (housing, locker rooms, etc.), and program exclusion. These types of investigations require different skills and methodologies from harassment investigations and are predicated on other policies.

ATIXA’s expert faculty members will guide participants through ATIXA’s recommended investigation process for sex/gender discrimination complaints, sharing practical knowledge and tips to prepare participants to investigate complex complaints. Click here to learn more.

Managing Intake, Jurisdiction, and Dismissals Workshop

This workshop is designed for individuals who want to improve their skills at managing compassionate intake, making jurisdictional determinations, and documenting the results of an initial assessment, including any dismissals, referrals, or appeals that may arise.

Attendees will participate in small group breakout sessions where they will work through a set of brief case studies that challenge them to apply the ATIXA practices. Applying Policy in Investigations & Determinations Workshop

11:00am-3:00pm ET

Title IX team members must deeply understand the Title IX policy-based offense definitions of their district, school, or institution. This includes complex legal constructs and terms of art. Deconstructing an offense definition into its component elements (parsing) is critical to effectively serving as an investigator or decision-maker, roles that must understand the process of converting policies into models of proof.

Participants will practice breaking down policy language into critical elements and using those elements to guide their analysis. ATIXA’s expert faculty members will demonstrate how to use policy deconstruction tools to provide clear insights into the tasks required during each phase of the formal grievance process.

Understanding Consent Workshop

Understanding and analyzing consent requires an appreciation of the nuances of how consent really works. ATIXA’s expert faculty members will lead a detailed discussion of consent, including legal and policy constructs, consent communication, implied consent/reciprocation, ratification, incapacitation, conditions on consent, and withdrawal of consent.

Attendees will participate in small group breakout sessions to apply these lessons to short case studies. Following this, participants will share their findings and consolidate their learnings into a coherent consent construct with guidance from ATIXA faculty. Click here to learn more.

Establishing a Violence Risk Assessment Process Workshop

The Title IX regulations mandate an individualized safety or risk analysis before an institution can limit educational access, such as emergency removal. This analysis often can and should take the form of a Violence Risk Assessment (VRA).

This workshop aims to assist practitioners in implementing an evidence-based process that reduces bias, mitigates legal risk exposure, avoids disability discrimination, and ensures consistency in determining (1) if a VRA is necessary, (2) who should conduct the VRA, and (3) what to do after receiving the VRA results report.

Participants will learn how to vet who conducts a VRA, how the VRA varies from other types of assessments, and how to work collaboratively with behavioral intervention, CARE, and threat assessment teams to ensure an efficient and thorough process. Click here to learn more.

Individualized discounts are as follows:

There are scholarships available for the Virtual Summer Workshop Series. Scholarships must be submitted by June 31, 2024 for which course you would like to apply for.

If your application is approved, you will be notified via email 2 weeks prior to your course start date. To apply, click here.

Those attending workshops will receive 4 recertifying credits (CCCs) for each current certification. All workshops will receive a digital badge denoting completion.
